Duties of the Superior Court Clerk
Primary Duties
The Clerk of the Superior Court is a state constitutional officer who serves a vital role in our community. The Clerk is an impartial officer answerable to the people of the County, who oversees an office responsible for the preservation and reliability of public records, helping ensure the smooth operation of the judicial system, and providing equal access and protection for all.
A well-run Clerk’s office maintains and provides timely access to accurate and complete public records, including real estate transactions, court proceedings, and public internal documents. This ensures transparency and efficiency and allows the public to obtain necessary information for legal, personal, and business purposes.
While the duties of the Clerk are set forth in State Code (O.C.G.A. Sec.15-6-62, et seq.), for those not familiar with the broad variety of duties of the Clerk, the following summary should be helpful.
Record-Keeping, Support & Management
- Maintain and secure all court records, including civil and criminal case files and appeals.
- Keep records of real estate transactions, including deeds, liens, and plats.
- Manage, preserve, and secure historical records and documents, including evidence in criminal matters.
- Manage the Board of Equalization and all staff, including the Clerk’s Passport Office.
Court Administration
- Manage the timely and accurate filing of legal documents and pleadings in civil and criminal cases.
- Issue subpoenas, summonses, and other court orders.
- Coordinate and ensure proper docketing and scheduling/calendaring of court cases.
- Maintain records of court proceedings and decisions.
Financial Responsibilities
- Collect, deposit, manage, disburse, and account for all court fees, fines, copying and other costs for all criminal, civil, and real estate matters.
- Collect, deposit, manage and account for all applications and fees for applications for persons to become (or remain) a Notary Public and for persons applying for United States passports.
- Oversee financial administration of the office, including budgeting, accounting, and audits.
- Manage the collection, deposit, and disbursement of funds in accordance with court orders, including restitution and child support payments.
Public Assistance
- Provide information and assistance to the public regarding court procedures and records.
- Assist individuals in accessing public records and understanding the legal process.
- Fulfill Open Records requests in the time and manner required by law.
Issuance of Licenses, Permits & Passports
- Issue various licenses and permits, including notary public commissions and U.S. passports.
Collaboration
- Work with other government agencies and departments to ensure the efficient operation of the judicial system.
- Coordinate matters and records with law enforcement agencies, attorneys, and other court officials.
